Thinking Outside the Box: ERISA, ACA & The Idaho MSA Program

A two-part presentation from Bret Busacker (Holland & Hart) and Adam Berry (American Health Value) covering ERISA, the ACA, and the new Idaho Medical Savings Account program that offers small employers another option to provide group health benefits without the headache, cost and liability of a sanctioned group health plan. Bret Busacker will discuss the general tax and benefits rules under ERISA, HIPAA, COBRA and the Affordable Care Act applicable to a wide range of common employer sponsored benefits programs, including employee assistance programs, wellness plans, on-site clinics, severance and voluntary employee benefits such as supplemental life and supplemental disability. Bret will address some common misconceptions and traps that employers should be aware of with respect to these arrangements. Adam Berry will outline the newly revitalized Idaho Medical Savings Account program from the perspective of the employer and the employee, both. He will discuss what an Idaho MSA is in general, how it functions as a group benefit, the differing levels of implementation, and why the installation of this program will allow employers of any shape/size to upgrade their benefit offerings for a negligible investment of organizational resources.
